DMCA Policy
Kraftec News respects the intellectual property rights of others and expects our users and contributors to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), it is our policy to respond promptly to any claim that content published on our website infringes the copyright rights of any individual or organization.
This page outlines our process for handling copyright infringement notifications and provides instructions for submitting a DMCA takedown request.
1. What Is the DMCA?
The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides guidelines for online service providers and website owners in handling copyright infringement complaints. It gives copyright holders a way to request the removal of infringing content and protects website operators from liability if they respond appropriately to legitimate notices.
2. Filing a DMCA Takedown Notice
If you believe that your copyrighted work has been used or posted on Kraftec News without authorization in a way that constitutes copyright infringement, you may submit a written DMCA notice with the following required information:
- Your full legal name and contact details (email address, mailing address, and phone number).
- A detailed description of the copyrighted work you claim has been infringed.
- The exact URL or location on our website where the infringing material is located.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Your electronic or physical signature.
Please send your DMCA notice to:
📧 Email: dmca@anmolkesarcompany.in
3. What Happens Next?
Upon receiving a complete and valid DMCA notice, Kraftec News will:
- Review the claim for authenticity and sufficiency.
- Temporarily remove or disable access to the allegedly infringing material.
- Notify the content uploader or author with a copy of the DMCA notice.
- Allow the uploader to submit a counter-notification if they believe the content was removed in error.
4. Filing a Counter-Notification
If you believe that the content was wrongly removed (e.g., due to misidentification or fair use), you may submit a counter-notice that must include:
- Your name, address, phone number, and email.
- Identification of the material removed or disabled and its original location on our website.
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
- A statement consenting to the jurisdiction of the appropriate federal court, and that you will accept service of process from the person who submitted the original DMCA notice.
- Your electronic or physical signature.
Once we receive a valid counter-notification, we may reinstate the content unless the original complainant files a lawsuit within 10–14 business days.
5. Repeat Infringer Policy
Kraftec News maintains a strict repeat infringer policy. Users or contributors who are found to repeatedly post infringing content may have their accounts suspended or permanently terminated at our discretion.
6. Disclaimer
Submitting false claims under the DMCA is a serious legal matter and may result in penalties, including legal costs and damages. Please ensure that you have the legal right to file a takedown request before submitting.
